Terms & Conditions

Welcome to DriveAway. These Terms & Conditions ("Terms") are an agreement between you and DriveAway ("DriveAway", "we", "us", "our"), a mobile app designed and built by a UK-based team that connects people in Algeria with car rentals, ride services, beach & watersports gear, and shared group rides. By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use DriveAway.

1. DriveAway is a marketplace, not a provider

DriveAway is a platform that connects users with one another — car owners and renters, drivers and riders, beach stations and customers, and people sharing group rides. We are not a car rental company, a transport company, or a party to the agreement between users. The service itself (the car, the ride, the equipment) is provided by the other user, and the contract for it is directly between the two of you. DriveAway does not own the vehicles, employ the drivers, or guarantee any listing.

4. Identity verification (KYC)

To help keep the community safe, users who rent out a car, list a car, offer rides, or run a beach station must complete identity verification and submit documents (for example a driver's licence, national ID or passport, and a selfie). We may approve, decline, or ask for more information. Verification helps confirm that users are genuine, but it is not a guarantee about any user or service.

6. Cancellations, changes & no-shows

Plans change, and either side may need to cancel. Please cancel as early as you can so the other person is not left waiting. A provider may set their own cancellation conditions for a booking; where they do, those conditions apply. Repeated late cancellations or no-shows may affect your rating or your access to the app.

7. No insurance — important

DriveAway does not provide any insurance — not for vehicles, drivers, riders, passengers, equipment, or property. DriveAway relies on verified identities for safety, not on insurance. Responsibility and liability for a rental or ride sit with the users involved (for example, the owner and the renter), according to the arrangement between them and applicable law. You are responsible for making sure you have any cover that the law requires or that you want for your own protection.

If you list a car, offer rides, or run a beach station, you confirm that you have the legal right to do so, that your listing is accurate and not misleading, that the vehicle or equipment is safe and in good condition, and that you will honour the price and details you publish. You are responsible for meeting any legal, licensing or tax obligations that apply to you.

10. Content you post

You keep ownership of the content you create — listings, photos, feed posts, reviews and messages. By posting it, you give DriveAway permission to host and display it within the app so the service can work. You must have the right to share what you post, and it must not be unlawful, misleading, offensive, or infringe anyone's rights. We may remove content or limit accounts that break these Terms.

11. Prohibited uses

You must not: break the law or help others do so; impersonate someone else; interfere with or try to break the app's security; scrape or copy the platform; use the app to send spam; or attempt to arrange payment or bookings off-platform in order to defraud another user.

12. Suspension and termination

You may stop using DriveAway and delete your account at any time (see the in-app delete option or contact us). We may suspend or close an account that breaks these Terms, creates risk for other users, or is used unlawfully. When an account is deleted, we handle your data as described in our Privacy Policy.

13. Disclaimers

DriveAway is provided "as is" and "as available". We work hard to keep it running well, but we do not guarantee that it will always be uninterrupted or error-free, or that any user, listing, vehicle or ride will meet your expectations. Because the service is provided by other users, DriveAway does not warrant the quality, safety, legality or accuracy of listings or of the users you deal with.

14. Limitation of liability

To the extent permitted by law, DriveAway is not liable for the acts or omissions of other users, for the condition or safety of vehicles or equipment, for disputes between users, or for indirect or consequential losses. Your dealings with other users — including the rental, the ride, payment in cash, and the condition of a vehicle — are between you and them. Nothing in these Terms limits any liability that cannot be limited under applicable law.

15. Changes to the service and to these Terms

We may improve, change, or discontinue parts of the app, and we may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. If you keep using DriveAway after a change, that means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Algeria, and any dispute relating to your use of DriveAway will be handled by the competent courts of Algeria, unless the law that applies to you says otherwise.
